Illegitimacy in Glasgow 1899

Post by bejantine78 » Thu Apr 10, 2014 9:29 am

Hi

I am having a bit of a senior moment here and need some assistance as I should know the answer... :?

If someone was born out of wedlock in 1899 I know the mother could ask for support through the courts for the child.

Where would I find these records? And what were they called - 'bastardy bonds' leaps to mind but that might be the English term?

Thanks

You could search the NAS catalogue http://www.nas.gov.uk/onlineCatalogue/ to see if anything is indexed. Sometimes there is an RCE attached to the child's birth entry if maintenance has been applied for.

Hi Annette

No there is nothing attached to the birth entry and the mother was back in England by 1901.

Do you know which court dealt with such matters? I have seen somewhere some reports of such things and I cannot remember where it was!

In Scotland it would possibly be an action for Aliment on behalf of the child and depending upon the time period raised either through the Court of Session in Edinburgh or through the local Sheriff Court. (I think in this case it would be more likely to have been Glasgow Sheriff Court)

However I believe that if such an action had been successful it would have resulted in the father being officially recognised as the father and the appropriate correction made to the birth Register.

Thanks

All I can do at the moment is scan the local press for any reports and as there were none I suspect she did not press charges.

If records remain they should be found in the NAS catalogue.
