Hi Lee
...and a warm welcome to TalkingScot! :D

I tried a few variations of the name on Scotland's People for your Robert but didn't come up with anything. Are you sure he was born in Scotland and not England? IGI has a couple you might consider looking into.

www.familysearch.org

1. ROBERT BIRNEY - International Genealogical Index
Gender: Male Christening: 09 MAR 1808 Farlam, Cumberland, England

2. ROBT. BURNEY - International Genealogical Index
Gender: Male Christening: 08 JAN 1809 Saint Peter, Bolton Le Moors, Lancashire, England

His children's naming pattern might give you some leads into who his parents might be.

Just something to think about until someone else might come up with the goods.

Regards,
Anne H

1851 census says he was born at Dumfries. :D

Still looking for 1841 but, although I think Ellen or Robert or both had been married before, I think he was probably in England in 1841.

He appears to have died in 1867 - have you seen his death cert?

Annette

Can't believe it -  I found him and it looks as though I was right. Here he is with his first wife.

Robert McBurney 30
Frances McBurney 25 born England but not Preston
Jane McBurney 5
Ann McBurney 3
John McBurney 1

Could this be the marriage?

Robert Burnie

Marriages:
Spouse: Frances Hayton Family

26 JUN 1836 Kendal, Westmorland, England

Annette

Thankyou Annette
I am getting a little confused now because on the 1861 census he is married to Ellen and has 7 children the oldest a girl called Ann age 22 then George19 and so on so this would indicate he had 2 seperate families.
Why would he drop the Mc part from his name strange :?
Dont know now if i have confused you too Annette what do you think?
Best Wishes
Lee

Hi Lee,

I have no doubt that he is the same person on all census records (no matter how his name was written).

I thought he had been married before as the way his children were listed on the 1861 census gave the impression of 2 families.
The 3 children on the 1841 match the 3 older children in 1851. His occupation also matches.

Here they are in 1851-

Robert Burnie 47
Ellen Burnie 40
Jane Burnie 15
Ann Burnie 13
John Burnie 12
James Burnie 10
George Burnie 9
Thomas Burnie 2
Marion Burnie 1

Looks like his first wife, Frances, died in 1847 at St John, Preston.

He married Ellen Lambert in 1848 at St John, Preston. Then they had children of their own. I also think Ellen had been married before and James and George are hers.

Obviously I can't be 100% without checking actual records but it makes sense to me.

I don't know much about English death records but maybe if you order that it would show if he had been married twice. I'm pretty sure it would also show his father's name.

Regards,
Annette

Hi Annette
English death entries do not name the parents of the deceased. :(

Well that's thrown a few more children into the pot :)
I have a David , Margaret & William (twins ) that obviously must of been born after the 1851 census
So it looks like Ellen Lambert is my ggggrandma as she obviously had little william my gggrandad
I am still unable to link Robert with where he was born on the census 1861 he states Scotland as place of birth but where is the question
I shall continue
Many Thanks
Lee

Hi Annnette
There is a column for "condition" where entries such as "spinster" and "batchelor" are written in the English certs. I have an example where "widow" has been written, and the bride is married under her pervious married surname with no indication of her maiden name, (other than her father's name being given)and the name of her previous husband is not given.

Best wishes
Lesley
