Isn't it ironic that Scotland Online will be responsible for for digitising all of the historical records in the 1911 Census for England and making them accessible. (From 2009 there will be a phased release of the 1911 census online.)?
Yet in Scotland, we will have to wait until 2012 for 1911 release, and no Freedom of Information enquiries, unlike England!

The FoI legislation in Scotland specifically excludes census data, unlike in England & Wales. Seethe GROS website for confirmation. In otehr words, no legal challenge is possible.
However, it's possible that the Scottish release will be on census day or very soon thereafter in 2011, rather than having to wait until 1st January 2012.
