Where to look for info re sheriff court deeds

Post by crayspond » Thu Jun 24, 2010 5:14 pm

Hi to all at TS,
Can anyone tell me how to find out more regarding the information below.

SHERIFF COURT OF FIFE DEEDS, 1715-1809
BEVERIDGE, JOHN: weaver in Dunfermline; Agreement with spouse, Mgt Deal, dated 1 May 1761 & rec 9 April 1791 [SC20/36/15]

I never found a marriage for them although on subsequent births she is named as his wife. Any help appreciated.

Regards

Ailsa

Hi Ailsa
SC20/36/15 can be found at NAS

You would need to contact them to get an estimate for copying the document - cost will cary depending on the number of pages.
Alternatively you could try your luck in the TS Tombola - but you'd better hurry as Ticket sales end tomorrow!!!!!!!!

Thanks Lesley for your usual quick response. I wondered if anyone who has came across this before might know what the terminology might be by "Agreement" and "rec".
I purchased my tombola tickets a while ago!

Hi Ailsa
"Rec" is recorded - that is the date the agreement was recorded in the book.

As to the precise meaning of "Agreement", given it is in the Fife Deeds, and deeds can be of several types e.g. it may be a document referring back to an earlier marriage settlement, or a document similar to a testament, but I'm not a legal person... my guess would be that it may be a document which states what is to happen to property, money or even children & etc in the event of John's death and perhaps John died around 1790/91 at which time the instructions in the content of the document would be recorded in the books - the original document was drawn up & dated 1 May 1761, but the contents of the documnet did not need to be acted upon until around 1791, which suggests to me that something happened around that time, possibly a death.

Best wishes
Lesley

Just looking at IGI, there is a submission which maybe hints at why you've not found a marriage - looks like the family were not CoS for the early children, (can't really tell for the later ones, but they all seem to be submissions which would suggeste perhaps no show in the OPR) so maybe also not CoS when they married.

Hi Lesley,

I did come to the same conclusion a while back that i would not find a marriage cert as i came across a submission re Associated congregation for some of the children - but i never gave up looking! This sheriff court deed might be worth having a look at.
Thanks for taking the time to look it up.

Hi Bruce,

Very interesting - this may have been the case with them - bit like modern day child support!
